ESCAPE FEE CALCULATOR
Fed up trying to calculate the escape fee? This Escape Fee Calculator will do it for you! Its pretty straight forward. Just complete the form and hit the CALCULATE button. The fee will be calculated and a little message confirms whether the Escape Fee has been exceeded.
This Calculator applies both the March 2014 and July 2015 fee cuts. The latter was reversed on 1st April 2016. Therefore all the rates were reduced by a total of 8.75%.
At the bottom of the page is a full explanation of how Escape Fees are calculated along with some notes which may assist you. But if you get stuck feel free to get in touch at any time.

How are Exceptional Cases assessed?
Cases that would be receive a Police Station Advice and Assistance Fixed Fee may qualify as Exceptional Cases if the costs of the case (profit costs, travel and waiting) when calculated using the hourly rates set out in the General Criminal Contract exceed a threshold set at three times the value of the relevant fixed fee. Cases that qualify as exceptional are paid the Police Station Advice and Assistance Fixed Fee and hourly rates for work carried out beyond the threshold.

Example:
Fixed Fee: £200
Threshold: £600 (three times fixed fee)
Costs (profit costs, travel and waiting): £1,500
Exceptional Case claim: £200 (fixed fee) plus £900 (£1500 profit costs - £600 threshold) = £1100;


Costs must be reported on the CDS6 inclusive of VAT (using the rates set out in the General Criminal Contract).

Notes:
i. Rates: The Escape Fee is three times the Fixed Fee. The Fixed Fee and scheme rates were taken from the General Criminal Contract published January 2008. The LSC are endlessly tinkering with it so please let us know when it changes. It was accurate at the time of publication of this calculator. We will do what we can to keep the calculator up to date.
 
ii. Duty Solicitor Serious Offences. The rates only apply when acting for Duty Clients but not Own Clients. We are very grateful to the LSC and in particular to the lovely Charlyn Johnson for her assistance in clarifying these rules:

· Causing Death By Dangerous Driving

· Assault by Penetration
· Rape of a child under 13
· Assault of a child under the age of 13
· Robbery
· Assault with intent to Rob
· Arson
· Perverting the course of public justice
· Conspiracy to Defraud
· Kidnapping
· Wounding or Grievous Bodily Harm
· Conspiracy to Commit any of the above offences
· Soliciting or Inciting to commit any of the above offences
· Attempting to commit any of the above offences
· Any offence if client's accused of possessing a firearm, shotgun or imitation firearm
· Any Offence under section 41 Terrorism Act 2000
 
iii. The Police Station Telephone Advice Fixed Fee is a set fee for all telephone calls whether routine or advice. It cannot be claimed for CDS Direct Pilot cases. It may be included in calculating whether a claim qualifies as an Exceptional Case under E2.2.8-10.
 
iv. Mileage is not included in the calculation and is merely included for completeness.
 
v. The calculator is written in javascript. If it is not working then you should first try to switch javascript on as your browser may be the cause of the problem. If it still does not work please contact us and we will see if we can help.
 
vi. All figures are presented without VAT being added. that struck me as a neater way of dong this. However, it would not be a very much effort to add VAT. If you would find that useful please contact me and I will add it.
 
vii. The GCC is very messy and the fixed fee figures are presented in a very odd way. I have amended them to make more sense. For example where the GCC lists Woodbridge/Felixstowe/Ipswich & District as one entry I have altered it to appear here as three separate entries.
 
viii. The basis on which the LSC assess Claims is set out in Part C, Rule 1.13. All rates are hourly, except where otherwise indicated.
 
ix. “Unsocial hours” means between the hours of 5.30 pm and 9.30 am on any business day and any time on a day which is not a business day.
 
x. “Business day” means any day other than a Saturday, a Sunday, Christmas Day, Good Friday or a bank holiday under the Banking and Financial Dealings Act 1971.
 
xi. The London rates apply to a fee-earner whose office is situated within the Commission’s London region. If an office situated outside the London region instructs an office within that region to act as agent, then London rates apply to the agent’s work. If a London-based office instructs an office outside London to act as agent, then that work must be charged at national rates.
 
x. The Escape Fee Calculator can deal with a job that splits across social and unsocial hours.
